Terms of Use

These Terms of Use govern your use of the BakeTally mobile application ("the App"), operated by NicHallSoftware — Nicholas Hall, a sole trader based in the United Kingdom, trading as NicHallSoftware ("we", "us", "our"). By downloading or using the App you agree to these terms.
1. The App
BakeTally is a tool for people who sell what they bake. It works out the cost of recipes and suggests prices, creates quotes and invoices, keeps an order diary, records payments you have received and produces a shopping list. Recipe costing is free. BakeTally Pro is an optional subscription that unlocks quotes, orders and the features built on them.
2. Subscriptions
- BakeTally Pro is an auto-renewing subscription, monthly or annual, purchased through the Apple App Store or Google Play. The price is shown in the App and in the store before you buy.
- Any free trial and its length are shown in the App before it starts. The terms shown at the point of purchase apply.
- Payment is charged to your Apple ID or Google Play account at confirmation of purchase, or at the end of any free period.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- You can manage or cancel your subscription at any time: on iPhone, Settings → Apple ID → Subscriptions; on Android, Google Play → Payments & subscriptions → Subscriptions.
- Refunds are handled by Apple or Google under their own policies. Nothing in these terms affects your statutory rights.
- If your subscription ends, you can still open the App, see your records and export your payment records.
3. Your account
You can use the App without signing up. Until you add an email and password ("Keep your recipes safe"), your data is tied to the phone it was created on and cannot be recovered if the App is removed or the phone is lost. You are responsible for keeping your login details secure.
4. Prices are your decision
The App does arithmetic on the numbers you give it. Suggested prices are a guide: they depend on the ingredient prices, quantities, hours and rates you enter, and you should check them before you quote a customer. You decide what to charge. We are not responsible for a price you quote, or for income lost because a figure was entered wrongly.
5. Not tax, legal or food-safety advice
- The App keeps records and exports them. It does not calculate tax, file anything with HMRC or any other authority, or give tax, accounting or legal advice. Keeping records that meet your legal obligations, including under Making Tax Digital, is your responsibility — speak to an accountant if you are unsure.
- The App does not deal with food hygiene, allergens, labelling, registration with your local authority or insurance. Meeting those requirements is your responsibility.
- Quotes and invoices are produced from what you enter. You are responsible for their content and for your agreement with your customer.
6. Payments between you and your customers
BakeTally never receives, holds or transfers money. If you choose to take a card payment, the App opens your own SumUp app; that payment is made under your agreement with SumUp and we are not a party to it. Payments you record in the App are your own records of what you were paid.
7. Your customers' information
If you record details of your customers, you are responsible for having a lawful reason to hold them, for holding only what you need, and for responding to your customers' requests about their data. How we store that information on your behalf is described in our Privacy Policy.
8. Acceptable use
You agree not to use the App for any unlawful purpose; attempt to reverse-engineer, decompile or extract source code from it; use it in a way that could damage, disable or impair our servers or networks; or attempt to gain unauthorised access to any part of the App or its systems.
9. Intellectual property
The App, including its software, design, text and graphics, is owned by or licensed to us. Your recipes, prices, quotes, customer records and other content you enter remain yours.
10. Availability
We aim to keep the App working and your data safe, but we cannot promise it will always be available or free of errors. Export your payment records regularly if you rely on them.
11. Limitation of liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special or consequential damages, or for loss of profit, revenue or business, arising from your use of the App. Our total liability for any claim arising from your use of the App shall not exceed the amount you paid for your subscription in the 12 months preceding the claim. Nothing in these terms limits liability that cannot be limited by law.
12. Ending your use
You may stop using the App at any time by cancelling your subscription and deleting the App. Deleting your account in the App removes your data as described in the Privacy Policy. We may suspend or end your access if you breach these terms.
13. Changes to these terms
We may update these terms from time to time. Significant changes will be announced in the App. Continuing to use the App after changes means you accept the updated terms.
14. Governing law
These terms are governed by the laws of England and Wales.
